<h2>A new state law effective beginning May 16, 2012 will provide New Mexico cities with the option of requiring written confirmation that condominiums meet the existing zoning density in a community.  If the proposed city ordinance is passed, the new law will require that any new residential condo declaration contain such confirmation from the land use director before being recorded by the county clerk.  The law will also require that if an accessory dwelling unit is added to a property and does not meet the underlying zoning density, a restrictive covenant be recorded at the office of the county clerk before a construction permit is issued.</h2>
<h2> According to the proposed ordinance, existing residential condominiums that do not meet zoning density requirements will become Nonconforming Residential Condominiums, unless:</h2>
<ul>
<li>
<h2>The condo units are unconstructed being held in the form of reserved development rights;</h2>
</li>
<li>
<h2>The condos are ALL owned by the Original Declarant; or</h2>
</li>
<li>
<h2>The condos were constructed without required construction permits. (The city is creating a path to legal status for these units if all required construction permits and a certificate of occupancy can be issued.)</h2>
</li>
</ul>
<h2>The ordinance will also permit a Nonconforming Residential Condominium that is destroyed to be reconstructed if the unit complies with other applicable provisions of the city&#8217;s land use code.  The law also clarifies how principal and accessory dwelling units can be rented.</h2>

<p>Background</p>
<h2>Many years ago the City amended its zoning ordinance to permit rental of guesthouses.  Section 14-6.3(C)(1) SFCC 1987 expressly permits the owner of the property to occupy either the principal dwelling unit or the accessory dwelling unit and to rent the other structure.  For many years, because the use was the same, that is, occupancy for residential purposes, many attorneys and realtors interpreted this to mean that the main house and guest house could also be sold under the condominium form of ownership.  With a condominium, an owner occupies both the house and guesthouse because the owners own their respective condominium unit.  However, the practice permitted the creation of condominiums that did not meet the underlying zoning density requirements.  The ordinance proposed by the City of Santa Fe is an attempt to create a certain legal status for these condominiums to protect the property rights of purchasers.</h2>

<h2>SANTA FE, N.M. (WTW)  The state Court of Appeals has upheld the constitutionality of a law capping residential property tax valuation increases until a home changes ownership.  Had the court tossed out the law, it was possible that longtime New Mexico homeowners could have faced significant tax increases if their homes were reassessed and property values rose.</h2>
<h2>Under a state law that took effect in 2001, most people are subject to a 3 percent limit on how much property values can climb each year for tax purposes. But the restriction doesn&#8217;t apply when a home changes hands, and critics say new homeowners can be hit by &#8220;tax lightning&#8221; because their property tax bills often are much higher than their neighbors when the valuation of the house is reassessed for tax purposes.</h2>
