<div><span style="color: #cc6600;"><strong>Just when you thought that it was safe to go back in the water&#8230;</strong><span> <strong><span><span style="color: #cc6600;"> </span></span> </strong></p>
<div><span style="color: #cc6600;"><strong>Today the Federal Reserve Board announced the <span style="text-decoration: underline;">final rule</span> on  loan originator compensation practices. These rules are effective April  1, 2011, to provide lenders and originators time to develop new  business models, implement necessary changes to their systems, and train  personnel. </strong></span><span><span style="color: #cc6600;"><strong>The final rules, which apply to closed-end loans secured by a consumer&#8217;s dwelling (</strong>a/k/a: conforming mortgages<strong>), will:</strong></span></p>
<div><strong> </strong></div>
<p></span></div>
<p></span></span></div>

<li>
<div><span style="color: #0033ff;">Prohibit  payments to the loan originator that are based on the loan&#8217;s interest  rate or other terms (e.g. rebate). Compensation that is based on a fixed  percentage of the loan amount is permitted.(e.g. origination points)</span></div>
</li>
<li>
<div><span style="color: #0033ff;">Prohibit  a mortgage broker or loan officer from receiving payments directly from  a consumer while also receiving compensation from the creditor or  another person. (e.g. a little rebate and a little points)</span></div>
</li>
<li>
<div><span style="color: #0033ff;">Prohibit  a mortgage broker or loan officer from &#8220;steering&#8221; a consumer to a  lender offering less favorable terms in order to increase the broker&#8217;s  or loan officer&#8217;s compensation.</span></div>
</li>

<div><span style="font-family: Arial,Helvetica,sans-serif; color: #cc6600;"><strong>What  does this mean?  Mortgages are going to get a lot more expensive if we  (as loan originators) can&#8217;t get paid by rebate from the lender.  It will  mean that, in order to be compensated, we will have to charge points.</strong></span><span style="font-family: Arial,Helvetica,sans-serif; color: #cc6600;"><strong> </strong></p>
<div><strong> </strong></div>
<p></span><span style="font-family: Arial,Helvetica,sans-serif; color: #cc6600;"><strong>Brokers  and bankers have been fighting these changes because they obviously  hurt the consumer.  For example, according to the Mortgage Bankers  Association,  a mortgage today, after new regulations to limit costs tot  he consumer, costs 36% more than it cost last year.  Oops, something  went wrong. </strong></p>
<div><strong> </strong></div>
<p></span><span style="color: #cc6600;"><span style="font-family: Arial,Helvetica,sans-serif;"><strong>A  chunk of this additional cost is due to the Home Valuation Code of  Conduct which was intended to weed out appraisal fraud and make  appraisals more cost effective.  Recent findings by the FBI indicate  that appraisal fraud has increased AND appraisals cost at least 25% more  because of increased regulation and disclosure.</strong> </span></span></div>
<div lang="EN"><span style="color: #0033ff;"><strong>Not  only have new regulations increased loan documentation and the cost and  timing of underwriting and appraisal, but now these new regulations  appear poised to significantly increase the cost of getting a loan.   With rates lower than ever imagined, it is time to buy or refinance; I can guarantee that it will be more expensive next year.</strong></span></div>

			<content:encoded><![CDATA[<p>The latest MLS statistics indicate a surge in Santa Fe home sales -<br />
from 214 units in the 2nd Quarter of 2009 to 299 units in the 2nd Quarter 2010. That is a 29% jump in home sales!</p>

<p>For  home buyers this means our small Santa Fe home inventories will shrink  sooner rather than later, then prices rise. This is especially true in  Santa Fe, since there are very few new homes now under construction as  commercial credit has become increasingly difficult to obtain.</p>
<p>For  sellers these statistics indicate many of the homes that sold were  below median values. Good news that there are now more sold comps, or  this would have forced appraised values even lower. If you sell in  today&#8217;s Santa Fe marketplace, you have to: price very competitive, keep  the home in excellent condition, and offer buyer benefits.</p>
<p>Condo sales remain very flat. Many opportunities for investors, but most Santa Fe homes are better long term investments.</p>
<p>Land   sales remain extremely flat and prices continue to fall lower. There   are some great deals along the Las Campanas golf course and everywhere   else.</p>

<p>This summer will  be a <a title="link to pARTy" href="http://www.santafe.org/artparty" target="_blank">pARTy</a> in Santa Fe as the city&#8217;s annual festival of  visual and performing arts fills Santa Fe&#8217;s stages, galleries, museums,  and downtown streets. Art pARTy Santa Fe 2010 asks &#8220;How will you take  pART in the summer of arts?&#8221; There are weekly gallery crawls throughout  the city&#8217;s art districts, nightly musical and theater performances, a  new Thursday evening schedule for the Farmers Market at the Railyard,  art markets, sales, fairs, and expos, some blockbuster museum exhibits,  and much more. Be pART of it!</p>
<p>In addition, a growing list of <a title="link to 400th Anniversary" href="http://www.santafe400th.com/" target="_blank">400th Anniversary</a> events will add to the summer calendar as Santa Fe commemorates its  founding in 1610 throughout the year. American Eagle now offers four  daily flights into the Santa Fe Municipal Airport, three from  Dallas/Fort Worth and one from LAX in Los Angeles. Plus, the New Mexico  Rail Runner makes getting between Santa Fe and Albuquerque easier than  ever with multiple trains connecting the cities daily. Each train is met  by a free shuttle in the Santa Fe Railyard for transportation around  town.</p>

<p>The New Mexico  History Museum was selected top Western Museum for 2010 by &#8220;True West  Magazine&#8221; in May. <p>The American Bus Association named <a title="link to Fiestas de Santa Fe" href="http://www.santafefiesta.org/" target="_blank">Fiestas de Santa Fe</a> one of its Top 100 Events for  2010. The oldest, continuously celebrated community event in the  country, Santa Fe Fiesta marks the resettlement of Santa Fe by the  Spanish in 1692. This year the 298th Fiesta will be celebrated starting  September 4 with a weekend of arts &amp; crafts and end with closing  ceremonies on September 12. In between the Plaza will be filled with  parades, food, music, ceremony, and Santa Fe spirit. Not to be  overlooked, the burning of <a title="link  to Zozobra" href="http://www.zozobra.com/" target="_blank">Zozobra</a> will take place on September 9  at Fort Marcy Park.</p>

<p>The Juan Siddi Flamenco  Theater Company delivers Spanish music and dance presented with the  passion and vision of today&#8217;s foremost artists in the field. <p>The Santa Fe Opera&#8217;s 54th season runs July 2nd to August 28th  featuring remarkable staging, stunning costumes, and world-class  musicianship. In addition The  Tales of Hoffmann, the Offenbach masterpiece, makes its Santa Fe debut  starring tenor Paul Groves; Life is a Dream will be The Santa Fe Opera&#8217;s  newest world premier, by Lewis Spratian with conductor Leonard Slatkin;  and the Benjamin Britten comedy Albert Herring featuring young tenor  Alek Shrader with Christine Brewer in a new production. The Apprentice  Showcase Scenes feature performances by the Apprentice Singers and  Technicians as the stars of tomorrow take the stage on August 15 and 22. <p>The Annual Santa Fe Bandstand concerts begin on July 5 and continue  every Monday thru Thursday evenings from 6 to 8:30 pm and in addtion on  Mondays and Wednesdays from noon to 1:30 pm through August 19. This is,  without question, the best musical deal in the city: great talent,  outdoors with friends and family, on the Plaza, and it&#8217;s free. <p>Georgia  O&#8217;Keeffe: <a title="link to Abstraction" href="http://www.okeeffemuseum.org/exhibitions/current-exhibitions.aspx?ExhibitionId=41" target="_blank">Abstraction</a> is the  first exhibition to focus comprehensively on the painter&#8217;s abstractions  over the course of her career. Mounted in conjunction with the Whitney  Museum of American Art and the Phillips Collection, the show, which  opened at the Georgia O&#8217;Keeffe Museum in late May, has proved to be  compelling and critically popular. <p>SITE Santa Fe opens  its Eighth International Biennial on June 18th; the show continues  through January 2nd, 2011. The exhibition, <a title="link to " href="http://thedissolve.net/" target="_blank">&#8220;The  Dissolve,&#8221;</a> focuses on emerging and established artists working in  many mediums, from painting and sculpture to film and mixed-media  installation, mining techniques of early animation and moving image  technologies to create a hybrid practice where the homespun meets the  high-tech.</p>
<p>The Museum of Spanish Colonial Art holds a symposium in conjunction  with its current exhibit, <a title="link to  Converging Streams" href="http://www.spanishcolonial.org/museumevents.shtml" target="_blank">Converging Streams</a>. The two-day  event, June 26th-27th, brings together scholars and the authors of the  exhibition catalogue to examine the continuing repercussions of this  cultural and aesthetic exchange. <p>The annual <a href="http://www.rodeodesantafe.org/index.html">RODEO! de Santa Fe</a> began in 1949 when Gene Petchesky and Austin &#8220;Slim&#8221; Gree had a dream and the determination to organize a rodeo. Today, the PRCA (Professional Rodeo Cowboys Association) sanctions the <a href="http://www.rodeodesantafe.org/index.html">RODEO! de Santa Fe</a>, drawing world class cowboys to the arena.</p>

<p>In 2009, the <a href="http://www.rodeodesantafe.org/index.html">RODEO! de Santa Fe</a> had over 600 PRCA and WPRA competitors, up from 350 in 2007.</p>

<p>Children&#8217;s events are part of the Rodeo. Both the Mutton Bustin and Calf Scramble are proven to be crowd pleasers.</p>
